# Terms and Conditions

Welcome to Thought Bubbles. These Terms and Conditions (“Terms”) govern your access to and use of the Thought Bubbles website, application, and related services (“Service”, “App”, “we”, “us”, or “our”).

By accessing or using Thought Bubbles, you agree to these Terms. If you do not agree, please do not use the Service.

## 1. About Thought Bubbles

Thought Bubbles is a minimal visual thinking app that allows users to capture short thoughts and view them as spatial, animated bubbles. The App is intended for personal reflection, lightweight idea capture, and creative organization.

Thought Bubbles is not a medical, mental health, legal, financial, or professional advice service.

## 2. Eligibility

You must be at least 13 years old to use the Service. If the laws of your country require a higher minimum age for online services, you must meet that age requirement.

By using the Service, you confirm that:
- you are legally able to agree to these Terms;
- the information you provide is accurate;
- you will use the Service only for lawful purposes.

## 3. Account and Sign-In

Thought Bubbles uses email-based magic-link authentication. You are responsible for maintaining access to your email account and for all activity that occurs through your account.

You agree not to:
- use another person’s email address without permission;
- attempt to access another user’s account;
- interfere with the authentication or security systems of the App.

We may suspend or terminate access if we believe your account is being misused or creates risk for the Service or other users.

## 4. User Content

“User Content” means any text, thoughts, notes, or other information you enter into the App.

You retain ownership of your User Content. By using the Service, you grant us a limited license to store, process, display, and transmit your User Content only as needed to operate, maintain, secure, and improve the Service.

You are responsible for the content you add. You agree not to submit content that:
- is unlawful, abusive, harassing, hateful, or threatening;
- infringes another person’s intellectual property or privacy rights;
- contains malware, spam, or harmful code;
- includes highly sensitive information that you are not comfortable storing online.

We do not claim ownership of your thoughts.

## 5. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which explains what personal data we collect, how we use it, and what rights you may have.

At minimum, the Service may process:
- your email address;
- authentication/session data;
- thoughts you create;
- theme and account preferences;
- waitlist or billing interest information;
- technical information needed to operate the App.

You should not use Thought Bubbles to store passwords, government ID numbers, payment card numbers, medical records, or other highly sensitive data.

## 6. Free and Pro Features

Thought Bubbles may offer free and paid tiers.

The free tier may include limits such as:
- a maximum number of thoughts;
- character limits;
- limited themes or features.

The Pro tier may include expanded limits and additional features such as more thoughts, more themes, exports, boards, archive, AI reflection, or other premium functionality.

We may modify, add, or remove features at any time. If a material change affects paid users, we will make reasonable efforts to notify affected users.

## 7. Waitlist

If you join the Pro waitlist, you agree that we may use the email address you provide to contact you about Pro availability, early access, pricing, or related product updates.

Joining the waitlist does not guarantee access, pricing, availability, or any specific feature.

## 8. Payments

Paid plans may be processed through third-party payment providers such as Razorpay or other payment gateways.

When you make a payment, you may be subject to the payment provider’s own terms, policies, and privacy practices. We do not store your full payment card details on our own servers.

Prices may vary by country, currency, promotional offer, or billing period. We may update pricing from time to time.

## 9. Refunds and Cancellations

Unless otherwise required by law or stated at the time of purchase:
- monthly subscriptions are billed in advance;
- annual subscriptions are billed in advance;
- lifetime or early-adopter purchases are one-time purchases;
- fees already paid are generally non-refundable.

If you believe you were charged incorrectly, contact us at support@thoughtbubbles.xyz within 7 days of the charge.

For subscriptions, cancellation stops future billing but does not automatically refund past payments.

## 10. Acceptable Use

You agree not to:
- copy, modify, reverse engineer, or exploit the Service except as permitted by law;
- overload, disrupt, or attack the Service;
- bypass usage limits or access controls;
- use bots, scrapers, or automated tools without permission;
- use the Service for illegal, harmful, or abusive purposes;
- attempt to access data belonging to other users.

We may limit, suspend, or terminate accounts that violate these Terms.

## 11. Intellectual Property

The Service, including its design, interface, branding, software, animations, logos, and visual style, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, reproduce, sell, or distribute any part of the Service without our written permission.

Your User Content remains yours.

## 12. Third-Party Services

Thought Bubbles may rely on third-party services for hosting, authentication, database storage, analytics, payments, email, or infrastructure.

These third-party services may include providers such as Supabase, Netlify, Resend, Razorpay, or similar services.

We are not responsible for third-party services that we do not control, but we aim to use reputable providers and reasonable security practices.

## 13. Service Availability

We aim to keep Thought Bubbles available and reliable, but we do not guarantee uninterrupted access.

The Service may be unavailable due to:
- maintenance;
- outages;
- third-party provider issues;
- security incidents;
- changes to infrastructure;
- events outside our control.

We may update, suspend, or discontinue parts of the Service at any time.

## 14. Security

We use reasonable technical and organizational measures to protect the Service. However, no internet-based service is completely secure.

You are responsible for:
- keeping your email account secure;
- using trusted devices;
- not sharing magic links;
- notifying us if you suspect unauthorized access.

## 15. Disclaimers

The Service is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim warranties of:
- uninterrupted availability;
- error-free operation;
- fitness for a particular purpose;
- accuracy or reliability of outputs;
- preservation of all User Content without loss.

Thought Bubbles is a thinking and note-capture tool. It is not a substitute for professional advice.

## 16. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, goodwill, or business opportunities.

Our total liability for any claim related to the Service will not exceed the amount you paid us in the 3 months before the claim, or INR 1,000 / USD 15 if you have not paid us.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

## 17. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:
- you violate these Terms;
- your use creates legal, security, or operational risk;
- we are required to do so by law;
- we discontinue the Service.

After termination, we may delete or retain data as described in our Privacy Policy and as required by law.

## 18. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will make reasonable efforts to notify users through the App, email, or website notice.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

## 19. Governing Law

These Terms are governed by the laws of India, unless applicable consumer protection laws in your country require otherwise.

Any disputes will be subject to the courts located in Coimbatore, Tamilnadu, India. unless applicable law provides a different mandatory forum.
